Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Swypr, the operator of swyprai.com and the Swypr mobile applications ("Swypr," "we," "us," or "our").

By creating an account, starting a subscription, or otherwise using Swypr (the "Service"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Swypr is an AI-assisted tool that helps you create editable TikTok Photo Mode / carousel slide posts and related captions from topics and briefs you provide. Features may include candidate post generation, slide editing, AI or uploaded backgrounds, optional fictional human hooks, caption and hashtag suggestions, and native-resolution export.

We may modify, suspend, or discontinue features with reasonable notice when practicable. Beta or experimental features may change or be removed without notice.

You must be at least 13 years old to use Swypr. If you are under 18 (or the age of majority where you live), you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

You must have the legal capacity to enter a contract and authority to use any payment method charged through the app stores. The Service is not available where prohibited by law.

You must sign in with Apple, Google, or email verification (via Clerk). You are responsible for activity under your account and for keeping access to your sign-in methods secure.

Provide accurate information. Notify us promptly at support@swyprai.com of unauthorized use. We may suspend or terminate accounts that are inaccurate, abusive, or insecure.

Swypr is a paid subscription Service with a hard paywall after onboarding. There is no free tier and no free trial. Access to generation features requires an active Swypr Pro subscription.

Plans and pricing are shown in the app via Apple App Store or Google Play (through RevenueCat) and may vary by region. Typical U.S. reference prices include:

• Weekly plan - billed every week.
• Monthly plan - billed every month.
• Yearly plan - billed every year.
• Occasional winback or promotional yearly offers at a discounted price, with terms shown in the offer screen.

Payment is charged to your Apple ID or Google Play account at confirmation of purchase. Subscriptions auto-renew unless you cancel at least 24 hours before the end of the current period in your store account settings.

Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current price for your plan. You can manage or turn off auto-renewal in your store Account Settings after purchase.

Deleting the app does not cancel your subscription.

Refunds are handled by Apple or Google under their policies. We cannot directly process store refunds.

AI generation consumes credits. Editing and exporting do not consume credits. Credit allowances and costs are displayed in the app and may be updated prospectively.

Credits refresh on a per-period basis tied to your plan and do not roll over. If a generation fails for reasons we determine are on us, we may refund the credits for that job.

Circumventing credit limits, creating multiple accounts to abuse promotions, or attacking our systems is a material breach of these Terms.

Subject to these Terms and an active eligible subscription, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service to create content for your own social accounts or for clients you are authorized to represent.

You may not copy, reverse engineer, scrape, resell, rent, or provide the Service as a competing API or bulk generation bureau unless we agree in writing.

You retain ownership of the briefs, uploads, and other materials you submit ("User Content"), and - as between you and Swypr - you own the outputs generated for you in the Service ("Outputs"), subject to these Terms, third-party model/provider terms, and applicable law.

You are solely responsible for User Content and Outputs you publish, including rights clearances for uploaded images, music you add on other platforms, claims you make, and compliance with TikTok, Instagram, or other platform rules.

Some jurisdictions require disclosure that content is AI-generated or AI-assisted. You are responsible for any required labeling.

You grant Swypr a worldwide, non-exclusive license to host, process, transmit, moderate, and display User Content and Outputs solely to operate, secure, and improve the Service for you (for example storing projects, rendering slides, generating images, and providing support).

We do not claim ownership of your User Content or Outputs, and we do not use your content to train our own foundation models. We do not sell your content.

You agree not to use Swypr to:

• Violate any law or others' rights (including privacy, publicity, and intellectual property).
• Create or request unlawful, hateful, harassing, extremist, sexually exploitative, or severely deceptive content.
• Depict or impersonate real private individuals or seek celebrity likenesses without lawful rights; human hooks must remain fictional.
• Upload malware or content you do not have rights to use.
• Interfere with or overload the Service, bypass rate limits, or scrape the Service.
• Misrepresent Outputs as human-only professional advice (medical, legal, financial) without appropriate review.
• Use the Service if we have suspended or banned you.

Outputs are produced by probabilistic AI systems and may be wrong, incomplete, biased, non-original, or unsuitable. Swypr is not a law firm, medical provider, or financial advisor.

Virality, reach, saves, comments, or revenue results are not guaranteed. Platform algorithms change. Any performance statistics we mention are illustrative research context, not a promise about your results.

You must review and edit Outputs before publishing.

The Service, including our software, design system, trademarks, logos, and brand assets, is owned by Swypr and its licensors. These Terms do not transfer any Swypr IP to you except the limited license in Section 8.

Feedback you send may be used by us without obligation to you.

Swypr is not affiliated with, endorsed by, or sponsored by TikTok, ByteDance, Instagram, Meta, Apple, or Google, except to the extent those companies provide sign-in, billing, or OS services you choose to use.

Your use of third-party platforms is governed by their terms. We are not responsible for those platforms' actions, ranking, removals, or account penalties.

You may stop using Swypr at any time and delete your account in Settings. You must still cancel any store subscription separately to avoid renewal charges.

We may suspend or terminate access immediately if you breach these Terms, create risk for other users or our providers, fail to pay, or if we discontinue the Service. Upon termination, your license ends. Sections that by nature should survive (including ownership, disclaimers, liability limits, and indemnity) will survive.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that Outputs will meet your expectations or platform rules.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWYPR AND ITS OPERATORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR OUTPUTS.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO USE SWYPR IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD 50, IF YOU HAVE NOT PAID ANYTHING.

Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted.

You will defend and indemnify Swypr and its operators against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your User Content, Outputs, misuse of the Service, or violation of these Terms or third-party rights.

We may update these Terms from time to time. We will revise the "Last updated" date and may provide additional notice for material changes. Continued use after changes become effective constitutes acceptance, except where applicable law requires otherwise.

These Terms are governed by the laws of the United States and the State of Delaware, excluding conflict-of-law rules, unless mandatory consumer protections in your country of residence require otherwise.

Before filing a claim, you agree to try to resolve the dispute informally by emailing support@swyprai.com with a description of the issue. If we cannot resolve it within 30 days, either party may pursue relief in a court of competent jurisdiction, subject to applicable law.

Nothing in these Terms limits rights you may have as a consumer that cannot be waived by contract.

These Terms, plus the Privacy Policy and any in-app disclosures for a specific purchase, are the entire agreement between you and Swypr regarding the Service. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or sale.

Apple and Google are not parties to these Terms and have no obligation to provide maintenance or support for Swypr. To the extent required by Apple's terms, Apple is a third-party beneficiary of this paragraph regarding the iOS app.
